The Supreme Law of the Land

OUR AMERICAN CONSTITUTION This is an article that I wrote years ago from the Mormon point of view, using references to the scriptures with my discussions of reasons why it is a wonderful document, and how its implementation works to preserve liberty and free agency, which I define. This is a MS Word document and either requires or displays best if you have MS Word installed on your computer.
Here are some responses by members of the General Authorities of the Mormon Church, including the late President of the Church, G. B. Hinckley. L. Tom Perry's is perhaps the most complimentary and enthusiastic, even generously asking if it would be all right if he quoted from my article.

It is the grossest hypocrisy to say that we can capture people for whatever stated reason and not give them the same protections from the American government as we give ourselves! Once a person is within the jurisdiction of our law, he is entitled to the full protections of the law, just as an American citizen is because he has the same rights. Special laws and ways of dealing with persons not Americans contradicts the very foundational rational and validity of our claim to unalienable rights (as a part of all men)!

The USA Patriot Act: America's Disgrace!

Civil Rights, and how the Supreme Law is being broken by those who took the oath:

The Oath Requirement for all civil officers (for even the policeman as it says all;
The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; Article VI

The Supreme Law is being broken by subverting/betraying the following Constitutionally guaranteed rights :

Some of the fundamental changes to Americans' legal rights by the Bush administration and the USA Patriot Act following the terror attacks, "911" (Associated Press, September 5, 2002):

* FREEDOM OF ASSOCIATION:
Government may monitor religious and political institutions without suspecting criminal activity to assist terror investigation.

* FREEDOM OF INFORMATION:
Government has closed once-public immigration hearings, has secretly detained hundreds of people without charges, and has encouraged bureaucrats to resist public records requests.

* FREEDOM OF SPEECH:
Government may prosecute librarians or keepers of any other records if they tell anyone that the government subpoenaed information related to a terror investigation.

* RIGHT TO LEGAL REPRESENTATION:
Government may monitor federal prison jailhouse conversations between attorneys and clients, and deny lawyers to Americans accused of crimes.

* FREEDOM FROM UNREASONABLE SEARCHES:
Government may search and seize Americans' papers and effects without probable cause to assist terror investigation.

* RIGHT TO A SPEEDY AND PUBLIC TRIAL:
Government may jail Americans indefinitely without a trial.

* RIGHT TO LIBERTY:
Americans may be jailed without being charged or being able to confront witnesses against them.

The USA Patriot Act is not lawful or legal even though passed by Congress and signed by the pushy President Bush because only the people can change the Constitution (and hence the "law"), and that by the provisions within the Constitution:

Habeas Corpus, the only specifed "right" in the Constitution before the enumeration of 10 in the bill of rights is violated by the Patriot Act, Bush, and all those who have supported the Patriot Act.

``It is manifest that it was not left to the legislative power to enact any process which might be devised. The article [5th Amendment, ed. by Dad] is a restraint on the legislative as well as on the executive and judicial powers of the government, and cannot be so construed as to leave congress free to make any process `due process of law' by its mere will.'' Murray's Lessee v. Hoboken Land and Improvement Co. 59 U.S. (18 How.) 272, 276 (1856).

My strong thoughts and poignant feelings about what we Americans are letting our "leaders" do is expressed by a founding father thus:
"They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety." - Benjamin Franklin, 1759

WE HAVE TURNED CHICKEN!
That is we are throwing away our freedoms to save our necks...hardly patriotic, and we call it
"The USA Patriot Act"!
